TVS Motors - My Vehicle had been accident by Authorized TVS Service provider

I S.Ashok Kumar (S/O) T. Soundarrajan from Porur, Chennai. I Purchased TVS Apache 180 from Goodwill Automotive, Annanagar on 26.07.11 bearing Engine no AE6GB2001437 chassis no MD634NE63B2G01496.I registered my vehicle in RTO(South-West) Chennai -92.Registration number of my vehicle is TN10AD4014.I was very much happy with the performance of the Vehicle from the purchase.

As I am residing at Porur,I used to service my vehicle at Laxmi automobile,Porur.I gave my vehicle service on 20.01.14 at 9.00AM wide JC no 6040 and I advised to take back my vehicle on the same evening 6.00PM.I have received the call from the service centre around 2.00PM and stating that the My Vehicle met an minor accident during test ride.Mr.Sinivasan Owner of Laxmi Automobiles requested us to provide RC book and Insurance to clear the vehicle from Kattupakkam police station. I logged the complaint call to TVS through toll free number. I was contacted by Mr.Velmurgan,TVS Motors and advice me to provide the documents as per the dealer request. Both have promised me that they will take the responsibility and will not put any trouble on me. I gave my documents as per Mr. Velmurugan advice.

I came to know from Police station that it was major accident and two persons injured badly. When I saw the vehicle, it was in bad shape. Seeing the condition of my vehicle, I refused to take back my vehicle. Mr. Srinivasan promised me that he will replace all the parts which was damaged during this accident at free of cost. He will take care of the police formalities on his own. I informed this entire incident to Mr. Velmurugan who contacted me on behalf of TVS Motors.

After several follow-ups,I got call from Laxmi automobiles stating that your vehicle is ready for delivery on 22.02.2014.When I went to take my bike, I observed most of the parts are recycled and painted(Petrol tank and Silencer) and appearance of my vehicle is very bad. I asked Mr.Sinivasan, regarding the new part replacement. He denied replacing new spares as per his commitment. Finally I accepted to take back my vehicle from the service centre. Now the condition of my Vehicle is very bad.

We have received the notice from Poonamalle court wide M.C.O.P.No 141 0f 2014.It was clearly mentioned we need to appear on the court on 5th day of June 2014 regarding the accident happened on 20.1.2014.When I called Mr. Srinivasan, Laxmi automobiles regarding court letter, He is telling us to take care of court formalities. I again logged the complaint on TVS customer care through toll free no. I have received the call from Mr.Manikandan, TVS motors and he advised me to change the bike through exchange offer.

Now I am not in the position to sale my vehicle due to this police complaint and also I am not in the position to provide compensation to person who injured in the accident. I have done all the activities as advised by TVS representatives. Now I am not getting any proper support from TVS representatives. I request you to take back the vehicle and refund the amount to compensate the loss incurred by me.

Please let me know the concrete solution to resolve my issue. Otherwise I am forced to fill the case on consumer court.
