I would like to lodge a complaint against a car dealer and car company. In this connection I need your help.



the mail which I wrote to the car Company is as under:




"Myself is rakesh Gupta. I bought a Chevrolet car which model is Aveo - uva on august 24, 2012 from m/s Arya Automobile, Mundka, Delhi, India. The car registration no. Is DL4CNA7793. Immediately on taking the delivery of the car, I took it for long drive. On driving the car, I noticed that there were following defects in the car:
1. The car had very bad pickup, on fifth gear I.e. Top gear with full escalator, the car was running beyond 80 kilometre per hour as compared to standard speed of 130 km per hour.
2. The car was making too much noise like a noise generated by aeroplane when it runs for take off.
3. Its air conditioner was not working properly. It gives cool air only:
a. When car runs on a speed higher than 60 km per hour while in India maximum times car runs at a speed of 30-40 km per hour.
b. Whether should not be hot I e. Temperature of climate should not exceed 32 degree calcius.

Immediately on returning to Delhi, I informed these facts to the representative of the dealer - Arya Automobile.
They took the car to their workshop.
However, every time dealer assured me that problem is rectified but every time I experienced that these problems still unresolved. Because these reasons, the car has gone for 7 times to the workshop. When car visited the workshop at seventh time, I made a complaint to Chevrolet customer care also. On delivering the car, the dealer asked me to sign the customer satisfaction note. However, based on my previous experience with the dealer, I refused to sign it and promised that if my complaints in the car would had been rectified, then only I will sign it. But the dealer submitted this customer satisfaction note by signing it at their own to the Chevrolet customers Care division and the Chevrolet customer care division closed the complaint without getting it verified from me. Evenly, after informing this fact several times to Chevrolet customer care division, they didn't take any action on this. In the meanwhile my car started facing another problem and this problem was so big, it was taking jerks during running and it started stopping during running time. One day I was along with my family coming from a place near to Jaipur and it was running on a speed of 70-80km per hour and it started stopping after every few second which caused the chances for five times for me to met with the accident. Though my family is saved because of gods help this could caused a major accident for me and my family. When I informed about this fact to the dealer they took the car with them. I informed this fact to Chevrolet customer care but they didn't took any action against this. The car is presently lying with the dealer.
My submission is that the company should take the car back to it because of the reasons:
1. Since it air conditioner was not working and it pick up was not good and it was making too much noise, it was not fit for its intended use even at its inception period as described aforesaid.
2. Because of aforesaid problems in the car at the inception stage, the quality of the car was not in line with the equality described about this on the Chevrolet website.
3. During the first year of its purchase, the car has undergone for repairs with the dealer from whom this car was purchased because of the aforesaid problems.
4. The problem has started in the car which is very big even after getting it repaired at workshop for ten times. This means dealer is, also making some manipulation in this either replacing its, parts with old one or creating the problem to get more money from me.
4. I believe that the dealer sold me second hand car.

Hence, please, look into this matter and took necessary action against the dealer
