Maruti and their dealer M s D.D. Motors - 12day old-Swift Dzire held for more than 3Yrs now in Accidental Repair (Maruti)

The Car (Swift Dezire) Registration No. DL8C Q 8510, was purchased by me on 08-01-2010 from M/s D.D. Motors, 5&6, Wazirpur Industrial Area, Near DTC Bus Depot, Ring Road, Delhi- 110035.
The car met with an accident on 20.4.2010, and was towed to the workshop of M/s D.D. Motors, 5&6, Wazirpur Industrial Area, Near DTC Bus Depot, Ring Road, Delhi- 110035. Since 20.4.2010, the vehicle is lying in the aforesaid workshop.

Since the vehicle was within warranty and was also covered by comprehensive Insurance Policy No. NO.MI11111110022945, the repair was undertaken by M/s D.D. Motors in terms of the Insurance Policy. M/s D.D. Motors got the vehicle inspected by the insurance surveyor and had also obtained necessary consent from the undersigned for carrying out necessary repair. On 30-04-2010., I inquired from M/s D.D. Motors about the progress of the repair work and they informed me that the vehicle is ready for delivery and necessary repair has been completed. However, when I reached the workshop on 04-05-2010, I noticed that the vehicle was not ready for delivery as despite number of self/ignition given it could not start.

I was then told by them that needful would be done and I would get the vehicle at the earliest.Thereafter I have inquired number of times about the progress of the repair work required to done but you they told me that the same would take some more time. My repeated visits to the workshop only gives me further assurances that the work would be finished as early as possible.

# In the month of 15th June, 2010, one engineer from M/s Maruti Suzuki had contacted me on telephone and told me that he was deputed by the company to inspect the vehicle.But I was not informed anything about the recommendations of the inspecting engineer.

# On 22.6.2010, I received a written communication from M/s DD Motors whereby I have been told that the vehicle could not be repaired as I have not given necessary permission to repair the engine.

By the said letter the M/s DD Motors attempted to find fault with me with regard to not giving you necessary authorization for undertaking repairing work or not taking the delivery of the vehicle. I may point out that according to M/s DD Motors the vehicle has already been repaired and later on they came to know that the engine of the vehicle is not responding and as such it requires mechanical repair. When I have not authorized M/s DD Motors to repair the vehicle then how they have repaired the vehicle.
As a matter of fact, the necessary authorization has already been given by me and thereafter a survey was conducted by the insurance company and M/s DD Motors have partially repaired the vehicle.
However mechanical repair has not been done despite repeated reminders.
No separate authorization is required from the customer to do mechanical repair in the case of accidental repair.

In reply to M/s DD Motors aforesaid letter dated 22.6.2010, I have sent a written communication dated 28.06.2010 whereby I have again authorized M/s DD Motors to do all mechanical repair and I further undertook to pay depreciation charges as the vehicle is within warranty and covered by a comprehensive policy.

As it is ,in an accidental case, when the vehicle is covered under the warranty and comprehensive insurance policy,
M/s DD Motors are bound to take necessary steps for proper assessment and survey from the insurance company for conducting repair whether mechanical or otherwise.
The customer can not be compelled to take the delivery of partially repaired vehicle. The allegation that I have not given necessary authorization to undertake the repair work is totally false and M/s DD Motors are deliberately concealing the true facts.

It is quite interesting to note that when the vehicle was towed to the workshop after the accident and the survey was conducted for assessing the accidental damage and for necessary repair required, then it must have been inspected for both mechanical and other repairs required. When the vehicle is covered by the comprehensive Insurance Policy, all accidental repairs whether mechanical or otherwise are required to be done under the Policy. Moreover the vehicle is within warranty and liability of the Company is continuing.

It would not be out of place to point out that via the aforesaid letter, M/s DD Motors had also informed me that I am liable to pay parking charges for parking of the vehicle for repair work to be done by M/s DD motors, under the Insurance policy and/or warranty.

It is amply clear that M/s DD Motors wanted to take advantage of their own wrong. Before this communication, they never asked me to take the delivery of the vehicle after the mechanical fault was noticed and rightly so as the repair work was not completed and as such the question of taking delivery of the partially repaired vehicle does not arise.
I am not liable to pay any parking charges and on the contrary they would be liable to pay me damages for not carrying out the necessary repair in time.

In response to my reply dated 28.6.2010, I received a Communication dated 7.7.2010, from M/s DD Motors, informing that written permission is required to do the mechanical work in the vehicle and I wrote to them stating that since they insist for written permission for opening of the Cylinder Head, I hereby gave you permission to open the Cylinder Head and do all mechanical repair work. However, I had made it clear that since the vehicle is within warranty and covered by a comprehensive insurance policy, I would only be liable to pay depreciation charges.
The liability of Maruti company is still continuing as the vehicle is within warranty. Despite my written permission, the work has not been done by M/s DD Motors and I visited the workshop number of times and they always told me that needful would be done at the earliest.

# I may also point out that during my visit to the workshop on 09.10.2010 I have noticed that some parts of my aforesaid vehicle has been stolen and I have also taken photographs of the same.
After noticing the same, immediately I met and informed this to the Manager , M/s DD Motors, who in a blunt reply told us that the Co. used to park the vehicle outside the workshop in the night and it is not Co.’s fault if some parts of the vehicle are stolen.

# The rude behavior of the Manager has not only surprised me but given a great shock as he refused to take the responsibility of the vehicle which is lying in their custody for conducting repair work. When the vehicle is in the custody of M/s DD Motors then how can they absolve themselves from theft of some parts of the vehicle.

It is the responsibility of M/s DD Motors to guard the vehicle till the same is delivered to the customer . On my protest, I was told that stolen parts have been restored but I apprehend that second hand parts are replaced in place of stolen parts which were new as vehicle met with the accident within 12 days from the date of purchase.

I have visited the workshop number of times but M/s DD Motors have not yet done necessary mechanical repair and has been still trying to find fault at our end and they are threatening us that they would take the matter to court.

I, therefore, request you to take necessary steps in this regard and direct M/s DD Motors to complete the repair work whether mechanical or otherwise and give delivery of the vehicle at the earliest.

Also, I would like to bring to the notice that I have mailed my complaint ,numerous time to the customer care : contact@maruti.co.in,But there is no reply till date!

Complainant's Goal: I want my money back or my car in the best condition as early as possible.

you should try contacting maruti on their CRM number 18001800 180 or email them at contact@maruti.co.in and they should get in touch with you at the earliest. It’s worked for me in the past

After reading this, I suggest everyone not to buy any car from DD Motors. The service is bad and no one can trust them. They make false commitments and at the end the customer suffers.
And its even strange that maruti didn't even replied.

After reading all this,its very wrong of M/s DD Motors to handle to this whole situation.
