I had placed 2 orders with India Today Book Club:
1. Domestic Holiday Package including a) 12 Books, b) 3 CDs, c) Return Air Tickets with Taxes for 2 Adults and 1 child and d) Stay in any of the 5-Star Hotels in India with Breakfast and Dinner.
Complaint: I have received only the books and CDs. I have not received any further information about the Holiday Package which is what was marketed by the marketing people. The agent, Rajendra, had informed me that within three days of receiving the books, I will be contacted by ITBC for delivering the details of the Holiday package. But there is no such sign even after 3 weeks and he is not receiving my calls anymore.
2. Combo offer of SAMSUNG MOBILE PHONE + PHILIPS HOME THEATRE + FUJIFILM DIGITALCAMERA with all accessories.
Complaint: I have received only the phone. There is no further news about the Camera and Home Theater. I called up Dilip, the senior marketing advisor from ITBC who had handled this order. But this person received my call only once and after coming to know the reason of my call, he simply disconnected the call. He is not taking my calls anymore. When I called up the customer care, they are playing a different game by telling that there isno such offer.
I once got reply from response@indiatodaybookclub.com that I have to claim my gifts from http://bookstoday.in/promos.htm. But this site shows that it is down for maintenence and that I have to login after 3 days. This condition is not changed for the past 10 days.
I have written several emails to all the available IDs: order@indiatodaybookclub.com, feedback@indiatodaybookclub.com, response@indiatodaybookclub.com, indiatodaybookclub@in.com and sales@offers.indiatodaybookclub.com. I have directly tried calling these people over phone and sent several SMSs to them to convey my concerns. But there seems to be no response of any kind from these people.
I need guidance as to how to proceed. There has to be some limit to the freedom with which these people have made it a habit to very conveniently cheat people and just escape.

The Sue ITBC Movement is gaining momentum very fast.
Our plan of action:
Activity Target
Increasing members Have 1,000 members by the end of November.
Getting legal help Prepare a draft of the case to be filed by end of November
Building a database of media to be approached Have a list of at least 1,000 journalists across national magazines and city-level English and regional newspapers
(The idea is to have individual journalist’s names and IDs so that we send mails to individuals rather than letters to editor. That way some one or the other will pick up our story)
Researching and documenting information about:
1. Handing the investigation of ITBC to CBI
2. International bodies and laws governing mail-order business and sales practices
3. National legal entities dealing with Sales Malpractices
4. NGOs supporting consumer groups
5. Filing cases in consumer courts (and getting all the paperwork ready)
a. The plan is to file the case in both consumer and criminal courts Having all information about all these ready by end of November
Making a contact list of all partners of Living Media (national and international) We will send mails warning the partners of the fraud that this company is running and ask them to terminate their partnership with Living Media

ITBC | Proposal For A Class Action Suit | Next Steps
Hi,
I am Sujata Garimella.
On August 25th I had got in touch with some victims of ITBC’s cheating and malpractices proposing a Class Action Suit.
I have started a movement for this @ ITBC | Sue Them
I had requested affected people to join in (ref attached doc: Proposal_for_a_Class_Action_Suit.doc) and I am happy to say that there are 167 members on this site now.
A representative of ITBC got in touch with me willing to close my case. But I firmly told him that it was not about me as an individual any more and he needed to address the concerns of the whole group. (ref attached document: Proposal_for_a_Class_Action_Suit_Mail_Exchange.doc).
After the last mail that I sent on September 2nd, there has been no response.
I am now moving to the next step which is: I am consulting lawyers and all the sections that ITBC can be sued under. (With limited knowledge, I think they can be sued for tort, fraud, lying, cheating, malpractice, unfair sales practices, criminal case etc.)

Companies like this get away with such scams because the consumer group is pan-India. We have some fora where we post our grievances but we have never formed a united front.
Because of this certain persistent individual grievances are settled but many go un-acknowledged. Finally out of being completely fed-up, we give up following the cheaters.
Let us not let that happen this time.
The scale of ITBC’s scam is the same size in the consumer domain as was Enron’s in the government domain. Just like Enron has become a classic example of Accounting malpractices in the international arena; let us make sure that ITBC is the example of Fraudulent Sales Practises in India.

ITBC | Fraudsters and Cheats | Proposal for a Class Action Suit

I am Sujata Garimella.
Like you, I too trusted the India Today name and had ordered stuff from ITBC. My experience was awful. I did not get what I ordered for. I did not get the promised "extras". And I did not get any solution either.
This whole nightmare started in September 2009 for me.
To top it all they still keep calling me.
I plan to sue them for Rs. 10 lakhs. I have started an action against them and would like more victims of ITBC's dirty tricks to join in because there is a lot of strength in numbers.

Like you and me there are lakhs of other victims of ITBC's malpractices. There is a link in the web page above that will take you to a list of the sites on which people have complained. I request you to take the time and send at least 50 of them this mail and ask them to send it forward.
That way we can reach the maximum number of people in the shortest period of time and quickly initiate legal proceedings.
I hope we have 10,000 people and then, if not getting the money we can at least ensure that the company closes down.

I support this complaint.
I got a phone call sumtime in august 2009 regarding domestic holiday package. I applied for it & paid Rs. 3198/- I recd the books but yet to recieve the return air tickets. In this regard, I hv called up onthe helpline numorous times but to no avail.
I also applied for Holday stay vouchers with 2 free international return tickets & paid Rs 5943 but same is still pending
