Samsung India - Defective TV Set supplied at the time of delivery, but not replaced/money refund

Sir,
This is in response to the telephonic conversation, we had on 14.01.2010 at 11:37 dialed through your mobile number ********06 over my mobile number ********25 and ********54. As promised by you over phone, I am taking this opportunity to remind you that 10 days are completing on 24.01.2010 by which you have committed to refund our hard earned money of Rs.16000/- spent towards purchase of a DEFECTIVE 29” COLOURED SAMSUNG TV MODEL NO.CS29A730 ON 19.06.2008. In this regard a complaint/request letter in Hindi containing three pages, is also attached herewith (FILE NAMES : COMPLAINT TO SAMSUNG (19.1.2010 & 19.01.2010).

Sir,
Please refer to my previous E-mails/complaints. Final complaint was sent in the month of September, 2009 after which your Engineer visited and repaired the set with the assurance that this defect will not appear again.

Regret to inform you again that within approximately three (03) months the same defect again occurred and your DEFECTIVE TV SET has started giving trouble again. This time I am not going to tolerate if pour hard earned money spent on this DEFECTIVE SET is not returned. I am writing a complaint to THE CHIEF MINISTER/PRIME MINISTER/MRS. SONIA GANDHI FOR THEIR INTERVENTION IN THE MATTER. After that I will contact CONSUMER FORUM, if my hard earned money is not returned.

You have really made a mockery of our grievance and are trying to delay the matter. I have also prepared my complaint with full details and it will be sent to different daily NEWSPAPERS of Delhi/India, if my problem is not solved, immediately.

Sir,
Please find enclosed herewith complaint against Samsung India Ltd. from whom I purchased above mentioned TV set which started giving problems within two months of purchase. I requested them through my various requests (mentioned in the enclosed letter) to replace the defective set but they kept it repairing all the times. But the defect was never rectified successfully but I kept on requested them to replace the set, but in vain.

Now the guarantee period has expired and they are not entertaining my request to replace the set. Though their Sr. Executive Mr. Arijit Kumar has accepted my request of replacement the defective TV Set vide BP No.********31 dated 14.9.09; but after they are delaying the matter and again sending their engineer at a cost of Rs.350/- as visiting charges, for repairing the set. I again requested them on 18.9.09; 22.9.09; 25.9.09; 26.09.09 and 29.09.09 but they are not entertaining it positively.

You are requested to kindly go through my letter/complaint addressed to Samsung in Hindi 03.08.2009 which is self-explanatory to which they did not responded. On seeing this I am requesting( vide my letter dated 14.09.2009 ) you to please look into my complaint and guide me if anything could be done in this connection.

Before going to Legal authorities (consumer forum; legal authorities) I would like to discuss this matter with you so that if anything positive could be done for replacement of this defective set which was purchased on 19.06.2008. IF REQUIRED, I CAN RECORD MY GRIEVANCE OVER PHONE SO THAT THE HARRASSMENT WHICH I AM EXPERIENCING IN THE HANDS OF SAMSUNG INDIA COULD BE SHOWN TO THE VIEWERS OF CNBC AWAAZ AND OTHER CONSUMERS OF SAMSUNG INDIA.
