Samsung India - Defective airconditioner on purchase

I bought one Samsung 1 Ton Split Air Conditioner on 23rd June 2006 by making full payment. Till date (18th July 2009) I am not able to use the machine as the outer machin has some defective parts as told to us by Samsung Engineer.
We have asked the dealer to replacethe machine but he is saying that he will replace the defective part only. We have not used the machine at all. So wh will take delivery of a defective machine. We want either a new machine or full payment back to us.
Kinldy do something against our problem.
