I got a sms from company on 5th january,2011 morning that my callertune charges of rs.30 will be deducted on 8th jan,2011. But suddenly rs.30 was deducted from my prepaid account balance on that day only and it's the practice of the company to deduct the callertune charges 2-3 days before the specified date(here the specified date was 8th Jan). So I thought that rs.30 deducted on 5th Jan would be of callertune.(Note: the practice of the company to deduct the balance 2-3 days before the specified date for callertune charges was observed by me only as I am having callertune service from 2-3 years).

Today, 11th day of January, I received a sms from company that my callertune charges will be deducted on 13th January. I actually got shocked bi reading that sms. Then I called company’s customer care at 08:50am. I talked with Tausif Sheikh. Firstly he said that I have used reliance world(a service provided by the company) and rs.30 deducted on 5th Jan was of that service only. When I replied that I had not used any service, he used to check details. Then after 1-2 mins he said that the service has been activated by company on his own and if I have called within 24 hrs. of the deduction of the prepaid account balance then only the charges would have been refundable. He clearly admitted that the charges have been deducted without my permission. Then he said that he is transferring call to his senior.

Then I talked with his senior. His name was Maruti Jadhav. He said that I should have called on that day only and now the charges can not be refunded. When I said that it is wrong to deduct charges without asking the customer, he replied that the company has called to ask me to start the service or not and I have replied in affirmative. This senior (Maruti Jadhav) is saying completely opposite to what his junior (Tausif Sheikh) said. (Tausif Sheikh said that the charges have been deducted without my permission). In fact I don't receive any calls from company and I have even lodged a request in the company that I don't want to receive any calls from company on 30th December,2010. It means that the senior was lying. When I said that I will lodge a complaint in Consumer Forum, he replied do whatever I wanted to do but the charges deducted will not be refunded.

According to Consumer Protection Act, 1986 it is a deficiency in service that company is starting any service without any permission from the customer. And the policy of the company to refund wrong deduction of charges only if the customer has called within 24 hrs. of deduction is unjustifiable. And from 5th of Jan till today I have not received any service from company then how would I know that any service is activated by company.

So please sir I request you to look into the matter and do the needful at the earliest.
