Era landmarks was giving advt in the newspaper and internet about their township in Gurgoan Sector-103 by the name Cosmos City. I contacted them thorugh their official dealer V S Realtor India Pvt Lt Mr Vijay jha and come to know they are also launching plots in that area for which I paid 60% of the plot value and was issued receipt from their office. I paid this entire amount through my Canara Bank NRE account. They made an agreement on Rs 100 stamp paper that if they fail to provide the said plot within 18 months, they will refund the money with interest after that. As they failed to give me plot as agreed I asked them in writing to refund the amount but they failed so far. I have given this written request to them on 13th June 2013 but they are giving all the excuses. I owe them about Rs 75 Lakhs.
My customer code with Era Landsmarks is 047/S0013 with respect of GDEP/103/133 for Gurgaon plots.
I need my hard earned money back as I a retired man now but see that I have to fight a lengthy battle with them to get my money back, which I am forced to do now.
Hereby requested the Era landmarks management and VS Realtors, to see the writing on the wall and mind , this is the hard earned money by me which they are holding beyond the agreed terms and conditions which will force me to take all the available legal options at my end which will ultmately spoil our relationship.

I am victim of Era Skyville for their Sector 68 sohna road property. Please let me know how legal proceeding should happen? We invested our life's earning and have been duped by ERA now. I am reading that everyone is asking to take a legal route, but has anyone actually done so?

Today I went to the site to assess the current situation of the project. I realize that there is no development . Also they have constructed only one building upto 5 floor and asked everybody to pay upto the level of payment.
Please let me know if the Phase-I also have been refunded. I am planning to put very strong lawyers who know how to deal wit h this .
Please let me know if there are others also in the same boat.

i am also a victim of Era.I was given post dated cheques for refund on cancellation of booking in cosmocity sector 103.All cheques were dishonoured.I would like to join the forum which is fighting the case collectively in court.May i know the contact details of person coordinating .
I have filed a complaint with commissioner of police in last week of july15

I too am a victim of Era. Three of my cheques have been dishonoured. VS Realtors, Gurgaon Vijay Jha is involved with Sumit Bharana; MD of Era/ Adel and has duped people. Vijay Jha does not attend calls and is soliciting clients from Indonesia, US, UAE and Oman among others. DO NOT DEAL WITH VIJAY JHA or his company/ brother.

Next, a petition for winding up of Era/ Adel should be filed separately in the Delhi HC along with the NI Act 138 and a complaint in the EOW, Delhi. A winding up petiton will ensure that Era MD cannot do any business hereafter in India.

The recent Cabinet approval for filing of the case under NI 138 will get a parliamentary assent in the current session of the Parliament and thereafter you can file a case where you have presented your cheques received from Era AND NOT IN NOIDA.

Please see Puneet Gupta vs Adel Landmarks in NCDRC website; plot sale in cosmocity; deficiency after collecting about 60lks, he enforced the terms of contract and Adel finally paid his initial deposits with interest as promised in the agreement;

In deference to our order dated 5.12.2014, Mr.A.K. Birla and Mr.R.K. Gupta are present in person. An affidavit of apology has also been filed in behalf of all the Directors named in the said order. While tendering an unconditional apology on behalf of the company for the delay in complying with the directions issued vide order dated 30.5.2014, it is stated that six Demand Drafts for the entire balance amount, in the name of Puneet Gupta, in the total sum of Rs.53,31,917/- (after deduction of TDS), details of which are as under, have been brought in the Court :

Said Demand Drafts have been handed over to Mr.Pankaj Gupta, the Power of Attorney holder of Mr.Puneet Gupta, the complainant. Mr.Pankaj Gupta has been identified by counsel appearing for Mr.Puneet Gupta.

On receipt of the said Demand Drafts, order dated 30.5.2014 stands complied with. Complainant is hereby directed to withdraw the complaint filed against the respondent company within two weeks from today. However, the certificate for the tax deducted at source shall be sent to the complainant by Registered Post in the first week of April 2015 at the address available in the records of the company.





While accepting the unconditional apology tendered by the Directors, we direct the company to deposit in the Consumer Welfare Fund a sum of Rs.40,000/- within four weeks on account of the delay in compliance with the order passed by this Commission. The notices issued to the Directors stand discharged.

Execution Application stands disposed of in above terms.

MY BOOKING IS IN COSMOCITY-3 FOR 3BHK.
I RETURN BACK UNIT FOR WHICH THEY ISSUE ME 6 PDC IN THE GAP OF 15 DAYS. THE VERY IST CHEQUE HAS DISHONOURED DUE TO INSUFFICIENT FUNDS. NOW THEY ARE SAYING TO HOLD ALL THE CHEQUES. THEY WILL PAY AFTER

I my self recently become the victim of ADEL Land mark Cheque bounce (for the property PH-1,Cosmocity Sec-103, Gurgaon).

I have also the same case with ERA but there is one very strange difference as i have booked my Flat in Phase-3 and they have given me the Builder-Buyer Agreement. That was done way back in 2012 end but after that there is no response from them. I dont know what to do? Is anyone else with the same situation having the Builder-Buyer agreement?

I am Mr SAM, I am also on same boat, we booked flat in 2011 Nov for 2 bhk and I have the allotment letter, they asked 11 lakhs upfront payment for the same. And still no news of builder buyer agreement, now the latest news is they sold the whole project with FSI 3500 psf to ansals, that is phase 2 and no news of construction and all lame excuses that BBA will be done in 3 mths and it been almost 2 yrs. my mobile ********21, we are planning to file FIR and hope will fight the case together.
