Under the instruction and authority from my client Shri Chandrakant S/o Sarjuram Verma, R/o Nagpur, I have to serve you with this notice as under –

That you Noticees are already aware that my client had filed of consumer complaint bearing No.673/2009 against you Noticees before the Hon’ble District Consumer Forum, Nagpur.

It is submitted that you Noticee No.2 had appointed your counsel but had failed to reply to the complaint and you Noticee No.1 even after receipt of Notice from District Consumer Forum, Nagpur failed to appear before Court and hence DCF, Nagpur proceeded exparte against you Noticee No.2.

It is submitted that on 12/04/2010 matter came to be heard finally and order and Judgment had been passed on 20/04/2010. By judgment and order dated 20/04/2010, the Hon’ble District Consumer Forum, Nagpur party allowed the complaint of my client and thereby directed you Noticees either to replace Nokia Mobile Handset Model No.3110 with new one or to pay the cost of the handset of Rs.4600/- along with 9% interest from 29/10/2008. It is submitted that Hon’ble DCF also directed you Noticees to pay Rs.1000/- for the mental, physical and financial Harassment and Rs.1000/-, towards the cost of litigation i.e. totaling Rs.2000/- within period of 30 days from the passing of order.

It is submitted that order was passed on 20/04/2010 but you Noticees had neither replaced the handset nor paid amount which amounts to contempt of Court. The non-compliance clearly amounts to deliberate disobedience and thereby making yourself liable to be prosecuted for criminal consequences.

You Noticees are hereby called upon to comply with the order of the District Consumer Forum within seven days form the receipt of this Notice otherwise my client shall constrained to file execution proceedings U/S-25 & 27 of Consumer Protection Act before the proper Court of law to execute the order and recover the aforesaid amount of compensation as well as to see that you should be dealt with criminal consequences. Please take notice and comply.

Notice charges of Rs.2000/-.
