TATA Indicom - TATA indicom photon+ fraud policy

I bought TATA indicom photon+ mobile broadband internet connection on 18th september 2009. I selected 950MB plan. In which 2GB data download is free during day time and 10GB data download is free during night time (11 PM to 7 AM).
TATA indicom has some different type of data calculation. According to their rules, If I have logged in internet connection during day time (before 11PM) and continuously used upto late night (3-4 AM). All the data downloaded after 11 PM will be considered in day time usage. If you want to take benefit of night surf plan, you have to logout and login again after 11PM. They have not explained anywhere in their welcome letter or prospectus of plans. This I came to know when I got the bill of Rs. 3539. Most of the data I downloaded during night time, but it was the continuous use after day time login. In fact , if my downloaded data has been calculated in night time, My bill would not exceed Rs. 700-800 (including taxes). According to their calculation my total download of 20 days was 5GB during daytime and 1 GB during night time. Am I made, that I am using in this way after taking a plan of 10 GB night surf.
Now, I understood the scheme. But, they should have explained these things earlier. Who is going to pay the five times bill of first month usage???

This is the trick to cheat the customer during first month of service.

Guide me how to drag these people in consumer court.
