IRCTC Indian Railways - I couldn't get refund of filed TDR

Dear Sir,

This refers to the PNR No.-2********5, which I got booked for journey of my Father on dated 1/03/2009, from Delhi To Jaynagar Station, in Tatkal Quota of Train No.-4650, IRCTC authorised Agent M/s- Yellow Planet, Rajnagar, Ghaziabad-201001. The supposed journey date was 4/03/2009.

But on above mentioned date the train was late by more than five hrs. As per latest information the train was supposed to arrive at Delhi station very late, My 60 Years old father was not comfortable to catch the train, in such scenario he decided to cancell his journey for the day.

As per the Railway rules & regulations TDR could be filed within 30 Days, I dipposited my father\'s ticket on 6th March, 2009 at concerned Agent & TDR was filed at the same time. I was given one TDR ref. No. as - ekt200********2091 & was told by the agent that you should wait for five to six months.

After seven months, I got information after inquiry that TDR filed by me could not approve & the refund is not possible.

As per agent wording - Your reserved berth was not shown empty by the TTE & now you are not entiteled to get refund.

Here it\'s not only the matter of five or six hundred refund.
I think this is completely concerned to the public rights which we are not getting.
Why should a general public should face such a biger problem....?
Why the rules are not being followed... ?
Should I move to consumer court... ?

you are requested to please look in to the matter as soon as possible.

With Reference to your PNR No: 2********5, we regret to inform you that refund is not admissible as informed by Railways through their letter no : EF/12285/T/08/26.02.09/NR.
