Subject: Complaint against “Senior Citizen’s Harassment by Bank Officials Since 2003” due To Home Loan A/c No-HL-22 at Branch Jogia-District Siddhartha Nagar-UP-272109


Respected Sir,

With reference to Subject, Complaint against Harassment of Senior Citizen by your Bank Officials, therefore Complainant Jamuna Prasad Srivastava S/o Late Basudeo Lal R/o- House No-46 Civil Lines, Tetri Bazaar- District-Siddhartha Nagar-UP-272207, aged about 75 Years, Ex Government Employee of U.P. Government, requested for Home Loan under Construction Loan Scheme with Branch Manager-Punjab National Bank-Branch-Jogia-District-Siddhartha Nagar in November 2002 for the Loan Amount of Rs. 2,50,000/, but Loan Amount Rs. 2,10,000/ sanctioned by the Branch Manager and Loan disbursed in Two Part.
First Part of the Loan was disbursed on 27th December 2002 for the Loan Amount of Rs. 1, 05,000/, and remaining Amount Rs. 1, 05,000/ has been disbursed on 13th January 2003.
And as per Bank Record Loan A/c No is – HL-22 and Mortgaged Property Address is House No-46-Civil Lines-Tetri Bazaar-District-Siddhartha Nagar-UP.

In view of aforesaid description Complainant would like to draw your kind attention towards Misappropriation, Irregularities, Irresponsibility, Miscreant and Harassment of Senior Citizen doing by your Local Legal Advisor and deputised Branch Manager-Jogia beyond jurisdiction and against law.
Complainant already filed a Civil Suit at Civil Judge Sr. Division-Court-District-Siddhartha Nagar and Case No is-429 in 2012 against aforesaid Miscreant, therefore Complainant requested with higher authorities of Bank As well As other Superiors of Government Authorities on the basis of following Grounds;

1.That Complainant Date of Birth is 1st July 1938, Aged about 75 Years, and at the time of Loan Application Complainant Aged was approximate 64 Years, and Source of Income was Pension i.e. only Rs. 3500/ Monthly and Annual Income was Rs. 42000/ only.

2. That Branch Manager-Jogia-District-Siddhartha Nagar sanctioned Loan for the Amount of Rs. 2, 100, 00/ on the grounds of Customer’s Age that was 64 Years and Monthly Income That was Rs. 3500/ Monthly.


3.That Branch Manager had taken 2 Salaried Class Guarantor, and did not take any Co-Borrower or Co-Applicant for aforesaid Loan, whenever Complainant was already 64 years old.

4. That Complainant signed the Loan Agreement and submitted 10 PDC’s for EMI and 10 Signed Blank Cheque at the time of Loan disbursement and All Cheques had been never represented for clearing neither receive any communication from Bank, Despite lots of persuasion and follow-ups with Punjab National Bank’s Branch Office and Regional Office located at Faizabad-UP, And deputised Branch Manager had ignored Complainant every time.


5.That Complainant had never received any communication such as; Sanctioned Letter, Amortisation Schedule, Recovery Letter, Collection Request, and Replaced Cheque Request from Bank despite several request.

6.That Complainant again visited the concern Branch in January 2005, met with New Branch Manager and asked about his Loan status, whatever New Branch Manager had checked the Complainant’s Loan File after that he could not provide any relevant Information, even he could not provide Loan Account Number. Therefore New Branch Manager said to complainant, kindly deposit any amount in his saving account of Punjab National Bank, and complainant deposited Rs. 2000/ in his saving account at that time and Branch Manager had also taken Complainant’s signature at Authority letter, thereafter complainant regularly deposited Lump-sum amount in his saving account. As per instruction from the Branch Manager, Complainant sends PDC’s to Jogia Branch through Registered Post.

7.That complainant was already Senior Citizen at the time of Loan Disbursal, and Complainant had 2 Elder Unmarried Daughters and 2 Younger sons and they were studying at that time, after those circumstance and liabilities, complainant had been visited Branch regularly and met with Branch Manager about Repayment of Loan Amount.

8.That complainant has been facing lots of troubles due to aforesaid Loan from Punjab National Bank; Complainant never expected this from a well cultured organisation like Punjab National Bank.


9.That Branch Manager-Jogia had visited at complainant’s residence with Legal Advisor and forced to complainant for signature at 100 Rupees Blank Stamp Paper. That Legal Advisor and Branch Manager are going beyond Jurisdiction and Against Law, therefore complainant have no any choice and way for Justice, except Court, Resulted complainant filed Civil Suit at Senior Civil Judge Court-District Siddhartha Nagar with reference to Civil Suit Case No-429 for relevant documents and irregularities against complainant Loan.

10.That Bank Officials and Legal Advisor never represented the required documents in Civil Court despite several reminders and Notices, except these, Legal Advisor and Branch Manager threatened and Insulted to Complainant by the way of Visiting at Complainant’s Residence, Registered Notice for Auction, Additional Payment Excluding EMIs etc.


11.That complainant had received his Loan Account Number on 18-05-2011 (After 8 Years Later), then knew about EMI amount and Loan Tenure i.e. Rs. 2310/ Monthly for 15 years, whatever Complainant could not understand the logic behind Loan EMI and Loan Tenure, How could be the Loan Repayment Term is 15 Years for a 64 Years Customer?

12.That Branch Manager and Legal Advisor are doing illegal activities As well As contempt of Court, They already instructed by the Civil Judge about these illegal Activities but they never respect Court’s procedures, they already mentally prepare for Harassment of 74 Years Senior Citizen, Who is paying Bank’s EMI regularly and Follow-ups with Court with lots of Insult, Harassment and Torture from Bank’s Officials.


13.That complainant unable to face these types Harassment and Illegal activities by the Branch Manager and Legal Advisor, Complainant’s health is not good. And the matter is still pending with Civil Court due to Non Co-operation and Lack of Documents, In These Circumstances How could Bank’s officials and Legal Advisor of the Bank can do Illegal activities beyond Jurisdiction and Against Law? In View of That, Why should not report this matter with Electronic Media and Print Media? Why should not Initiate the Criminal Proceeding Against Bank Officials?

14.That Complainant’s Loan Account is not in NPA category, so Bank’s officials cannot send Notices for Auction of Mortgage Property, as per RBI guidelines a notice will be sent to the borrower under Section 13(2) of the SARFAESI Act. This can be done only after the loan is classified as NPA as per the RBI-given guidelines. And Legal Advisor is continue send these types of Notices.
Prayers

That the Complainant accordingly prays that;

1.That Complainant should receive Loan Agreement, Sanctioned Letter, and Amortisation Schedule of Home Loan with the Information of Tenure of Loan and Repayment Terms and Conditions.

2.That Complainant should receive any further Information or Notices through Court neither directly when the matter is still pending with Court also stopped Torturing, Insulting and harassing, this is beyond Jurisdiction and Against Law.

3.That the Complainant case should investigate by the High Level Committee or Officials of Bank except Branch and Regional Level officials.

4.That Complainant has been already paid approximate Rs. 2, 56,000/, which is higher than the Disbursed Loan Amount and Bank cannot take any hidden cost or penalties without proper intimation to the Customer.


5.That as per RBI Guidelines Punjab National Bank is liable to Pay Compensation against Harassment and Torture of Senior Citizen.

6.That the Complainant is now stopping Pay EMI till the Case is Pending with Court.


7. That Bank’s Officials should Co-operate with Court and submit relevant documents in the Court, which pending case can be dispose off As early as possible without wasting any more time in wrong and Illegal Activities.

That as per Punjab National Bank, Recovery Department New Guidelines Dated 31st May 2012-Recovery Division, CIR No-16/2012, On the basis of this Guideline Complainant requested with authorities kindly close the Loan on the basis of till date payment and release the mortgage property paper, Complainant has already paid Rs.2, 56,000 (Approximate), against the Loan Amount of Rs. 2,10,000/, Complainant is 74 Years old age person and complainant does not want to waste his and Bank’s time and money in unnecessary lengthy court proceeding in this age.

How can survive in this Country,when 74 years old senior citizen is harassing by the Banker
