DS Max Properties - Query regarding flat booking

Hi,

I have booked a flat with DS Max Shelton (DS-Max Properties Pvt Ltd | The Joy of Living). I had to pay two instalments of Rs. 100,000 and Rs. 5,60,000 to get a soft copy of the agreement. On going through this, I was shocked to see too many costs added to the agreement. One such is the Khata transfer cost which is mentioned as Rs. 25000/-.

Nowhere have I seen such a high cost being charged by BBMP for Khata transfer. I checked with my lawyer too and he too agreed that its more than double of what should be the exact cost. I spoke to the Finance Manager, but he behaved very rudely with me. On escalating to the Managing Director of DS Max, I got a similar kind of response. Their only argument is "You are not paying anything to DS Max. You are paying it to BBMP."

They forget that if I can get Khata transfer for a lesser amount, why should I pay so much?

For my booking, I have received a booking form from DS Max with the amounts mentioned. On the terms and conditions, it is mentioned that if I need to cancel the booking, Rs 5% (yes, Rs. 5%) will be withheld by the builder.

I now want to cancel the booking without paying anything to the builder. Can the consumer forum help me with this?
